Burning Regulations in Kitty Hawk

Residents and visitors are required to follow these guidelines when burning within the Town limits. Please contact the Town Fire Department at (252) 261-2666 with additional questions.

Beach Fires

It shall be unlawful for any person to ignite, cause to be ignited, or maintain a fire on the ocean beaches within the town.

Fires in Other Areas of the Town

Allowed burning must be natural material such as:

  • Grass Clippings
  • Tree Limbs
  • Untreated wood products
  • Charcoal

Fires Allowed Without a Permit

  • Enclosed in containers, including burn barrels, non-combustible fire pits-either homemade or commercial
  • Fires used for cooking
  • Small campfires at a designated campground

Fires Requiring a Permit

  • Open pit fires
  • Burning of yard debris, not in an enclosure

*All open burning must be between 9:00 AM and 6:00 PM

Fire Permit Requirements

  • Fire can be no larger than 2 feet in height and 3 feet around
  • Wind speed must be less than 10 mph
  • Fire cannot be within 50 feet of a structure
  • Must be constantly attended with a water hose and rake or shovel

Fire Burning Permit Request Form

The NAME on the permit must be the name of person responsible for the burn. No organization or company names will be accepted.

If your fire becomes out of control you shall contact Dare Central Communications by dialing 911 or 473-3444 and report same.

INSTRUCTIONS TO PERMITTEE

This permit Does Not relieve the permittee of:

1. His/her responsibility for complying with all air pollution laws, regulations and ordinances (such as NC “Control & Prohibition of Open Burning” Regulations as codified in 15 NCAC 2D.0520) which prohibits the open burning of materials without first obtaining a permit from the Division of Environmental Management unless one of the exceptions listed in the regulation applies.

2. His/her responsibility for complying with all other Town, State and Federal Forest fire laws (such as notifying adjoining landowners, keeping a competent watch over the fire, etc.)

3. His/her responsibility for any damage the fire may cause to other parties or their property. Good judgement should be used when burning even though a permit has been obtained.

Note: The proper time to burn is: (1) following a rain when the wind is calm; (2) after grasses are green and hardwood leaves are mature.

AS PERMITTEE, I UNDERSTAND:

• This permit may be canceled upon written or verbal notice given by any Town of Kitty Hawk Official, and I will take immediate reasonable steps to extinguish the fire if ordered to do so or reimburse the Kitty Hawk Fire Department for expenses incurred therefore on my behalf.

• Pursuant to G.S. 113-60.29, conviction of violating the Open Fires Law or this permit is a misdemeanor carrying a fine of not more than fifty dollars ($50.00), or imprisonment for not more than 30 days, or both. These penalties may be imposed in addition to any civil or criminal penalties sanctioned under any and all North Carolina General Statutes.
